Pampers Dry Max class action lawsuit settlement thrown out, sending case back to lower court




CLOVERDALE, CALIFORNIA, August 15, 2013-

Almost two years after Procter & Gamble reached a settlement in a class action lawsuit filed in US federal court on behalf of parents who claimed their children developed diaper rashes following use of some Pampers Dry Max diapers, an appellate panel overturned the agreement and sent it back to the lower court for new action. P&G now has to decide whether to litigate the case or seek a new settlement.

Adam Shulman of Washington-based Center for Class Action Fairness LLC, attorney for the appellant in the case, said that "we're extremely pleased" by the ruling, which "adopts our organization's view of unfair settlements" such as that originally reached in the Dry Max case.
