Fameccanica.Data S.p.A. (Fameccanica) owns patents protecting many of the innovative solutions it provides in the hygienic disposable absorbent converting industry.  For example, Fameccanica owns European Patent No. 1355604 entitled “Disposable absorbent garment such as a diaper or training pants and a process of making the same” and its counterpart U.S. Patent No. 6,994,761.  Fameccanica also manufactures and supplies equipment to customers under these patents which were duly issued by both the European and U.S. Patent Offices, respectively.

Curt G. Joa, Inc., a Fameccanica competitor, has now alleged that Fameccanica’s European Patent (UK) No. 1355604 and U.S. Patent No. 6,994,761 are invalid, and has filed proceedings against the Fameccanica patents in the English courts and the U.S. Patent Office respectively.  Although the proceedings are ongoing, neither tribunal has found that the Fameccanica patents are invalid.  Each patent remains valid until there is a final determination that it is invalid by the relevant tribunal.  Fameccanica considers the allegations by its competitor to be meritless and is confident that the patents will be upheld.  It therefore intends to vigorously defend its patent rights through the proceedings instigated by Curt G. Joa, Inc., and beyond as necessary.
